General Terms of Sale
Last updated: 7 October 2026
1. Seller and contact details
The website japanime.it is operated by Japanime di Daniele Ballini, registered office at Via Ilio Barontini 22 / BA13, 50018 Scandicci (FI), Italy, VAT IT05988020482, REA FI-594961 (“Japanime”).
Contact: info@japanime.it, +39 366 3529482.
2. Scope
These terms govern distance purchases made through japanime.it. Mandatory protections under Italian Legislative Decree 206/2005 (the “Consumer Code”) apply to an individual purchasing for purposes unrelated to their business, commercial, craft or professional activity (a “Consumer”). The Italian Civil Code and other relevant rules apply to customers purchasing in the course of business.
Before submitting an order, customers are invited to read and retain these terms and the policies referred to in them, which form an integral part of the terms where applicable.
3. Products and pre-contract information
Japanime sells official collectibles related to anime, videogames and movies. Product pages state the essential characteristics, price, availability and any status as a preorder, used or “ex-demo” item. Safety information, warnings, manufacturer identification and, where applicable, details of the responsible person in the European Union are also made available before purchase when required by applicable law.
Images are illustrative. Minor differences in colour, finish or packaging caused by the viewing device, manufacturer or mass production do not in themselves constitute defects, without prejudice to statutory conformity rights. Where packaging is a material part of the collectible, its condition is also taken into account when assessing conformity.
Customers must follow the manufacturer’s age recommendations, warnings and instructions. Collectibles not intended for children’s play must not be used as toys.
4. Prices, taxes and promotions
Prices are stated in euros and, unless otherwise indicated, include applicable VAT. Delivery charges, any duties and other costs are shown before the order is submitted. For deliveries outside the European Union, import duties and taxes are payable by the recipient unless expressly included at checkout.
Promotions apply for the stated period and under their stated conditions. When a price reduction is announced, the prior price is determined in accordance with applicable law, normally by reference to the lowest price charged during the previous thirty days, subject to statutory exceptions.
No surcharge is applied for use of a specific payment method where prohibited by law.
5. Ordering process and conclusion of the contract
Customers select products, review the order summary, enter the required details and may correct errors before confirmation. Submitting an order creates an obligation to pay the total shown at checkout.
An automated order receipt confirms that the system has received the order. The contract is concluded when Japanime sends an order confirmation to the address supplied by the customer, unless that communication expressly states that further verification is required. The confirmation lists the products, prices, charges and essential order details.
6. Errors, unavailability and refusal of an order
In the event of a manifest pricing mistake, subsequent unavailability, duplication or technical anomaly, Japanime pauses preparation, checks the issue and contacts the customer promptly. The price of a confirmed order is not changed unilaterally: if the order cannot be fulfilled on the confirmed terms, Japanime offers a solution which the customer is free to accept, or cancels the order and refunds all collected sums without undue delay.
Japanime may refuse or cancel an order for legitimate reasons, including well-founded indications of fraud, unauthorised payment, breach of law or inability to deliver, while respecting customer rights and returning all sums due.
7. Availability and product statuses
- In stock: the product is recorded as available when viewed. Simultaneous purchases or inventory errors may exceptionally result in unavailability after ordering.
- Coming Soon: the product has been ordered from the supplier and will be shipped within approximately 10 business days, unless the supplier communicates a change or a different estimate appears on the product page.
- Preorder: the product is not yet available. Dates or windows supplied by the manufacturer or distributor are estimates and may change.
If an order contains items with different availability, it is shipped when all items are available, unless a different arrangement or service is expressly offered.
8. Payments
The payment methods actually available are shown at checkout and may vary by country, currency, amount and device. Providers may require additional security checks.
Bank transfer is also available under the conditions stated on the “Payments” page. For bank-transfer orders, preparation starts once funds have cleared and the order may be cancelled if payment is not received by the stated deadline.
Japanime never requests a customer’s full card number or login credentials by email.
9. Preorders
Full payment is required for preorder items. They will be shipped when they become available. If you purchase items with different availability in the same order, they will be shipped together once they are all available.
Arrival dates are estimates and may be brought forward or postponed by the manufacturer or distributor. Japanime communicates material updates of which it becomes aware. A delay does not remove a Consumer’s mandatory rights; cancellation, withdrawal and refund requests are handled in accordance with applicable law and the dedicated policy.
Orders already confirmed with a deposit before these terms were adopted retain the conditions agreed at the time of purchase.
10. Shipping and delivery
Served areas, costs, carriers and estimated times are stated in the “Shipping and Delivery” policy and at checkout. Unless a different deadline has been agreed, delivery takes place without undue delay and no later than thirty days after conclusion of the contract. For preorders and goods not immediately available, the different period disclosed before purchase applies.
In the event of delay, a Consumer may require Japanime to deliver within an additional appropriate period and, where the statutory conditions are met, terminate the contract, without prejudice to cases in which the deadline was essential or Japanime refused to deliver.
11. Transfer of risk, address and failed delivery
Risk of loss or damage passes to the Consumer when the Consumer takes physical possession of the goods, unless the Consumer independently selected a carrier not offered by Japanime.
Customers must provide a complete and accurate address and cooperate with delivery. If a parcel is returned because of an incorrect address, uncollected storage or another cause attributable to the customer, Japanime contacts the customer and may request the actual cost of redelivery, without affecting any mandatory statutory protection.
12. Damaged or missing parcels
Customers are invited to inspect the parcel upon delivery and, where possible, accept visibly damaged parcels subject to a specific reservation. It is helpful to report the issue promptly to info@japanime.it with the order number, a description and photographs of the parcel and product. Failure to make a reservation or immediate report does not deprive a Consumer of statutory guarantee rights.
13. Right of withdrawal
A Consumer may withdraw from the purchase within fourteen days of delivery, without giving a reason, as described in the “Returns, withdrawal and refunds” policy. Where multiple goods are delivered separately, the period runs from delivery of the final item in the cases provided by law.
After giving notice of withdrawal, the goods must be returned within fourteen days. The Consumer bears the direct return cost unless Japanime states or offers otherwise. Opening a collectible’s packaging does not automatically extinguish the right of withdrawal; however, the Consumer is responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Exceptions to withdrawal apply only in the cases provided by Article 59 of the Italian Consumer Code, including goods made to the Consumer’s specifications or clearly personalised. The exception for sealed goods applies only where its statutory requirements are met.
14. Legal guarantee of conformity
Consumers benefit from the legal guarantee of conformity under Articles 128 et seq. of the Italian Consumer Code. As seller, Japanime is liable for lack of conformity appearing within two years of delivery, subject to the statutory rules on limitation periods and burden of proof.
Where the statutory conditions are met, the Consumer is entitled first to have the goods brought into conformity by repair or replacement, free of charge, and in the cases provided by law to a proportionate price reduction or termination of the contract. Used or “ex-demo” goods retain the legal guarantee on the applicable terms; a characteristic specifically described and separately accepted by the customer before purchase does not constitute a defect.
15. Refunds
Refunds due are made without undue delay and normally to the original payment method, unless otherwise agreed and at no cost to the Consumer. For withdrawal, refund deadlines, refundable amounts and the right to withhold reimbursement until the goods or evidence of dispatch are received follow the Consumer Code and the dedicated policy.
16. Accounts and proper use
Customers are responsible for the accuracy of supplied information and confidentiality of their credentials. They must use the website without compromising its security, integrity or operation. Where there are concrete signs of unauthorised payment, unusual automated orders, false identity or promotional abuse, Japanime may carry out proportionate checks and temporarily pause fulfilment.
17. Liability
Japanime is liable in accordance with law for performance of the contract and does not exclude or limit liability that cannot lawfully be excluded or limited, including liability for fraud or gross negligence, personal injury, the legal guarantee and mandatory Consumer rights.
Japanime is not liable for delays or failures caused by unforeseeable and unavoidable events outside its reasonable control, subject to its duty to inform the customer and take reasonable measures to mitigate the effects.
18. Complaints and alternative dispute resolution
Customers may send complaints to info@japanime.it, stating the order number, describing the issue and attaching photographs where useful. Japanime responds within a reasonable time and seeks a solution consistent with applicable law.
After submitting a complaint, a Consumer may contact an ADR body included in the relevant official lists. The former European ODR platform has been discontinued and is not indicated as an active channel.
19. Personal data
Personal data is processed in accordance with the privacy policy published on the website and applicable law. Payment and delivery services may process the necessary data as independent controllers or processors under their respective notices and applicable agreements.
20. Governing law and jurisdiction
The contract is governed by Italian law, without depriving a Consumer of any mandatory protection granted by the law of the country in which the Consumer habitually resides. Disputes with a Consumer fall within the jurisdiction of the court of the Consumer’s place of residence or domicile where required by law. For business-to-business relationships, the Court of Florence has exclusive jurisdiction unless otherwise agreed in writing or required by mandatory law.
21. Amendments and severability
The version of these terms available when the order is placed applies. Subsequent amendments do not retroactively affect contracts already concluded. If any provision is invalid, the remaining provisions continue in force.
